This book examines current debates about the emergence of an international legal norm of democratic governance and also considers some of the wider theoretical issues to which those debates give rise. It asks; should international law seek to promote democratic political arrangements? If so, on what basis, and using which of the many competing conceptions of democracy?

This collection of essays, offered in honor of the distinguished career of prominent political philosophy professor Clifford Orwin, brings together internationally renowned scholars to provide a wide context and discuss various aspects of the virtue of “humanity” through the history of political philosophy.

Although living conditions have improved throughout history, protest, at least in the last few decades, seems to have increased to the point of becoming a normal phenomenon in modern societies. Contributors to this volume examine how and why this is the case and argue that although problems such as poverty, hunger, and violations of democratic rights may have been reduced in advanced Western societies, a variety of other problems and opportunities have emerged and multiplied the reasons and possibilities for protest.

Researchers from diverse disciplines, including organismal and cellular physiology, sports science, human nutrition, evolution and ecology, have sought to understand the causes and consequences of the surprising variation in metabolic rate found among and within individual animals of the same species. Research in this area has been hampered by differences in approach, terminology and methodology, and the context in which measurements are made. Recent advances provide important opportunities to identify and address the key questions in the field. By bringing together (...) researchers from different areas of biology and biomedicine, we describe and evaluate these developments and the insights they could yield, highlighting the need for more standardisation across disciplines. We conclude with a list of important questions that can now be addressed by developing a common conceptual and methodological toolkit for studies on metabolic variation in animals. (shrink)

Sebald's application of Walter Benjamin's view of historical process (an attitude toward history expounded upon at length in an influential work by Susan Sontag), the author's sense of irony about the human predicament is irrepressible. 1 Human beings seem destined to remain prisoners of various paradoxes—they both create and destroy, they are (...) capable of acts of love as well as bitterness and hate, they make efforts to document and communicate, but at the same time they tend to forget and are given to suppressing the truth, they are driven by ideals, yet remain hobbled by imperfection. Art and music, passed on from generation to generation, seem to be the most common way that human beings transcend the strictures of their imperfections, inadequacies, and their finitude. And to the extent that art indeed survives over time, and continues to be perceived and appreciated by beholders, the aesthetic enterprise succeeds. However, ultimately, as the Book of Ecclesiastes and Shelley's "Ozymandias" remind us, all human endeavor is in vain, and, to assume the perspective of physical cosmology for a moment—and in this regard Benjamin's cosmic vision appears painfully accurate—our speck of earth, dwarfed by a vast universe the true immensity of which has been revealed by the Hubble Telescope, will one day be ground to dust and debris like the rings of Saturn, and our sun will exist only as a burned-out hulk. But such a future world, devoid of beholders, and devoid of creators and their artifacts, is not Sebald's primary subject, even though it clearly forms the teleological backdrop for his third novel, The Rings of Saturn (1995, English version 1998). Rather, Sebald pursues his art in spite of a terminal prospect that will ultimately confront our [End Page 395] planet and solar system. His primary subject, the effect of trauma on individual and collective experience, is instead closely linked with the passing of Europe as a tradition, as an idea—as an idiosyncratic and innovative, but inherently corrupt contributor to cultural history. In the course of his narratives he also addresses the redemptive role of art in memorializing the past and attempting to capture the passing present. In both respects he attends to the humane and the sublime as well as the tragic and the grotesque.Paraphrasing the art historian Svetlana Alpers, one early reviewer of Sebald's novel Austerlitz (2001) points out the self-contradictory nature of preserving the transient moment in art:Why create visual art at all when everything on earth must be represented in its inexorable transitoriness; why paint earthly scenes with such incredible care and precision as if they were permanent? 2The care and precision of the painter's craft (in this case, the Dutch still-life painter David Bailly) are devoted to the representation of a scene that is by its very nature transient and even tenuous—like the scenes of sublime beauty in Sebald's fiction, the artist's depiction "courts and admits" its own fragility. What Bailly does visually, Sebald attempts in words. Take, for instance, the following passage from Vertigo, Sebald's first novel, which was titled in German (with considerably more irony) Schwindel. Gefühle 3 :At a hairpin bend I looked out of the turning bus down into the depths below and could see the turquoise surfaces of the Ferstein and Smaranger lakes, which, even when I was a child, on our first excursions into the Tyrol, had seemed to me the essence of all conceivable beauty.(p. 176)The author has already prepared the reader for this moment of awe by remarking on the otherworldly "slow-motion quality" of the waterfalls descending from the mountain cliffs and on the boulders in their screes spreading downwards into the wooded hillsides, "screes which reached from the mountains down into the forests like pale fingers into dark hair..." In Freedom Within Reason, Susan Wolf charts a course between incompatibilism, or the notion that freedom and responsibility require causal and metaphysical independence from the impersonal forces of nature, and compatibilism, or the notion that people are free and responsible as long as their actions are governed by their desires. Wolf argues that some of the forces which are beyond our control are friends to freedom rather than enemies of it, enabling us to see the world for what it (...) is. Carpendale & Lewis's theoretical reconstruction of the “theory of mind” problem offers new hope but still has far to go. The study of atypical development may provide some useful insights for dealing with the work ahead. In particular I discuss three issues – the boundary problem, the question of end states, and the issue of the centrality of triadic interaction.

Pickering & Garrod's (P&G's) theory of dialogue production cannot completely explain recent data showing that when interactants in referential communication tasks have different views of a physical space, they accommodate their language to their partner's view rather than mimicking their partner's expressions. Instead, these data are consistent with the hypothesis that interactants are taking the perspective of their conversational partners.

What does it mean to claim Jesus as Lord over the principalities and powers in a world where oppression, terror, and death so often seem to have the last word? Jesus' “answer” is not an intellectual explanation but a charge and a benediction, to guide believers and empower them to persevere.

In New Testament times, Job was considered a model of “steadfastness.” Job persevered by looking ahead to God's salvation. New Testament authors similarly portrayed Jesus as one who stood fast in time of trial, even unto death, thereby breaking the power of sin and strengthening Christians to standfast in their own trials.

The paper explores the severity of the problem of soil erosion and a variety of approaches to the problem. The typology of approaches includes doing nothing, individual party litigation, the state's invocation of public trust doctrine, and the state's exercise of its police power. The Reinvest in Minnesota Program reflects the state's exercise of its police power and addresses the problem of soil erosion by retiring marginal land from crop production through conservation easements. Revonsuo’s influential Threat Simulation Theory predicts that people exposed to survival threats will have more threat dreams, and evince enhanced responses to dream threats, compared to those living in relatively safe conditions. Participants in a high crime area differed significantly from participants in a low crime area in having greater recent exposure to a life-threatening event . Contrary to TST’s predictions, the SA participants reported significantly fewer threat dreams , and did not differ from the Welsh participants in responses to (...) dream threats . Overall, the incidence of threat in dreams was extremely low—less than 20% of dreams featured realistic survival threats. Escape from dream threats occurred in less than 2% of dreams. We conclude that this evidence contradicts key aspects of TST. (shrink)

Though scholarly consensus has long associated Beowulf with the Bear's Son folk tradition , many have felt that the Grendel episode comes closer to an Irish folktale called “the Hand and the Child.” Wilhelm Grimm first noticed the similarities between the episode and Irish narratives in which a hero defends a hall against a monstrous attacker, and variants of the folktale were adduced as analogues a century ago by Ludwig Laistner, Stopford Brooke, and Albert Stanborough Cook. In 1903 George Lyman (...) Kittredge collected variants, gave the story a name, and briefly discussed its structure and similarity to the poem. This study remains important for both sides in the subsequent debate because, while showing that the variants represented a widespread and consistent pattern, Kittredge expressed skepticism over its relationship to Beowulf. Raymond W. Chambers endorsed that verdict in the second edition of his Beowulf: An Introduction. (shrink)

Power density spectra and phase synchrony measurements were taken from intracranial electrode grids implanted in epileptic subjects. Comparisons were made between data from the waking state and from the period of unconsciousness immediately following a generalised tonic–clonic seizure. Power spectra in the waking state resembled coloured noise. Power spectra in the unconscious state resembled coloured noise from 1 to about 5 Hz, but at higher frequencies changed in two out of three subjects to resemble white noise. This boosted unconscious gamma (...) power to a higher level than conscious gamma power. For both gamma and beta passbands, synchrony measurements showed more widespread phase synchrony in the unconscious than the conscious state. We conclude that neither gamma activity per se nor phase synchrony per se are neural correlates of consciousness. (shrink)

Malcolm-Smith, Solms, Turnbull and Tredoux [Malcolm-Smith, S., Solms, M., Turnbull, O., & Tredoux, C. . Threat in dreams: An adaptation? Consciousness and Cognition, 17, 1281–1291.] conducted a rigorous study that sampled two populations differentially exposed to threat in real life, and found that critical predictions from the Threat Simulation Theory of dreams [Revonsuo, A. . The reinterpretation of dreams: An evolutionary hypothesis of the function of dreaming. Behavioral and Brain Sciences, 23, 877-901.; Revonsuo, A. . Did ancestral humans dream for (...) their lives? Behavioral and Brain Sciences, 23, 1063–1082.] were not supported. Specifically, we found no evidence of increased realistic threats to physical survival or enhanced threat avoidance in the dreams of those from the exposed population. Revonsuo and Valli’s [Revonsuo, A., & Valli, K. . How to test the threat simulation theory. Consciousness and Cognition, 17, 1292-1296.] commentary on our study argues that the methods we used are so flawed as to render the results meaningless. This paper explores the idea that a name should be associated with a reference condition, rather than with a referent, just as a sentence should be associated with a truth condition, rather than with a truth value. The suggestion, to be coherent, needs to be set in a freelogical framework (following Burge). A prominent advantage of the proposal is that it gives a straight-forward semantics for empty names. A problem discussed in this paper is that of reconciling the rigidity of (...) names with seeming truths of the form “there might have been such a planet as Vulcan.”. (shrink)

How successful are Fregean theories compared with guise-theoretic Millian theories in dealing with a range of problematic propositional attitude ascriptions? The range considered is roughly that of Paderewski puzzles and their relatives. I argue that these fall into two categories: in one category, the Fregean theory looks to be under pressure from guise-theoretic rivals, though I argue that Fregeans can, to advantage, borrow some guise-theoretic machinery. Concerning the other category, which includes Kripke's two Paderewski puzzles, I argue that these puzzles (...) are neutral between Fregean and Millian approaches; more generally, they have no direct bearing on semantics. Their solution requires correct views about rationality, self-knowledge and transparency. (shrink)
